WELCOME TO THE NACHA STATE TAX CHANGE NOTIFICATION SERVICE!

The National Automated Clearing House ("NACHA") is pleased to offer the State Tax Change Portal (the "Service") in conjunction with Federation of Tax Administrators ("FTA") as a way for state tax administrators to share with financial institutions, payment processors and other business and commercial entities information about changes in state tax payment requirements for business taxes. You may subscribe to the Service on behalf or your organization or agency by submitting the relevant identification and contact information in the fields provided on the registration pages and accepting these Terms of Service ("TOS"). State agencies that submit information for distribution through the Service are referred to below as "State Subscribers" and recipients of that information are referred to below as "Commercial Subscribers." References below to "Subscribers" mean both State Subscribers and Commercial Subscribers. You may unsubscribe from the service by clicking on the "unsubscribe" option at the bottom of each notice.

DESCRIPTION OF SERVICE

Through the State Tax Change Portal, NACHA will deliver notices of tax payment requirement changes in state tax collection practices it receives from State Subscribers ("Tax Change Notices") to Commercial Subscribers. Each State Subscriber, in its discretion, may send Tax Change Notices to NACHA for redistribution to Commercial Subscribers. Each State Subscriber authorizes NACHA to use, distribute, reproduce, publish and display such information as part of the Service and to send the Tax Change Notices to the e-mail addresses provided by Commercial Subscribers. As a courtesy, the FTA may attempt to verify the source, validity and content of the Tax Change Notices prior to distribution to Commercial Subscribers, but neither the FTA nor NACHA undertakes any obligation to verify the source, accuracy, completeness or quality of the content of any Tax Change Notice. The submission by State Subscribers of Tax Change Notices to NACHA for distribution through the Service is voluntary and for the convenience of Subscribers. NACHA and the FTA have no obligation to ensure that notices of changes in state tax collection practices are made available through the Service.

DISCLAIMERS

NACHA does not participate in the gathering or preparation of the content of the Tax Change Notices and NACHA does not verify, evaluate or guarantee the source, accuracy, completeness or quality of the content of any Tax Change Notice. Content of each Tax Change Notice is informational only and is provided "as is" without warranties, representations, or guarantees of any kind. NACHA disclaims any and all express or implied warranties with respect to the Service and each Tax Change Notice, including warranties of title, merchantability, fitness for a particular purpose and non-infringement. NACHA also does not guarantee the delivery of any Tax Change Notice to any Commercial Subscriber. Accordingly, each Subscriber acknowledges and agrees that:

  • any use made of the Service and any Tax Change Notice is at the Subscriber's own risk;
  • NACHA is not responsible for reliance on the Service or any Tax Change Notice, including any losses, damages or other consequences thereof;
  • it is the responsibility each Commercial Subscriber to determine whether, how and to what extent any Tax Change Notice will be applicable to it; and
  • each Commercial Subscriber will not use a Tax Change Notice as a substitute for advice from a qualified legal, tax, accounting, financial or other qualified professional.

ACCURACY OF INFORMATION

Each Subscriber represents and warrants that any information that the Subscriber provides to or through the Service, including any contact information and the content of any Tax Change Notice, is complete and accurate.

MODIFICATIONS OR TERMINATION OF SERVICE

NACHA reserves the right at any time, and from time-to-time, to modify, discontinue, suspend or terminate the Service or any Subscriber’s use of or access to the Service, and to modify these TOS by posting notice on this website or sending notice to any contact point listed in your Subscriber information. NACHA shall not be liable for any such modification, discontinuation, suspension or termination.

NO COMMERCIAL REUSE OF STATE TAX CHANGE NOTICES

A Subscriber may not reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purpose, the Service, any Tax Change Notice, or the content thereof, in whole or in part.
